Illinois Prohibits AI Therapists from Treating Clients

Illinois Bans AI as Therapists, Joining Other States

Illinois has prohibited the use of AI as therapists, adding to similar restrictions already established in Nevada and Utah. The state’s governor, JB Pritzker, recently enacted a law focusing on regulations surrounding chatbots in the mental health sector.

The new legislation bars all AI-driven tools from providing mental health guidance or therapeutic advice, which notably includes diagnosing patients. Those who break the regulations set out by the WOPR Act may face fines up to $10,000 from Illinois regulatory authorities.

However, human therapists are still allowed to utilize AI for certain administrative purposes, like note-taking and planning.

Kyle Hillman, the Legislative Director of the National Association of Social Workers, voiced concerns about unregulated behavior allowed by these algorithms. He highlighted the need for safeguards as technology evolves.

As technology becomes an increasingly ingrained part of individuals’ everyday lives, more people are seeking advice—including for dating—through digital platforms.

Bale Wright, a senior director at the American Psychological Association, expressed that “licensed occupations should be protected from misrepresentation.” He warned that misleading claims about expertise could jeopardize public safety.

Additionally, the new legislation is impacting user experiences with existing AI applications, which are now required to include disclaimers.

Reportedly, users in Illinois attempting to create profiles with the AI app ASH therapy currently face barriers. The app’s operators are considering ways to comply with the state’s policies before resuming their services.

Concerns have also been raised about the potential negative effects of generative AI chatbots, such as OpenAI’s ChatGPT. Reports indicate that these technologies can lead some vulnerable users into troubling mental states, conceivably exacerbating issues like paranoia and substance abuse.

Interactions with chatbots have even led certain individuals to develop harmful mental fantasies. Online discussions have noted a rising trend where users claim that such technologies might induce mental health problems, reflecting growing unease regarding AI’s impact on mental well-being.
