Virginia Teenagers Suspended Over Locker Room Incident

Two teenagers from Virginia have received a 10-day suspension after a video surfaced, raising questions about a female student who was identified as male in the boys’ locker room.

Loudoun County Public Schools (LCPS) imposed the suspension following a Title IX investigation earlier this year, according to attorney Josh Herzer, who represents the family of the boy involved. It appears the investigation concluded that the boy was found responsible for sexual harassment and discrimination based on sex, which led to considerable backlash from his parents and Virginia’s attorney general.

Herzer noted that the boys’ families were informed of the decision on Friday. Curiously, the school district has not publicly disclosed the suspension details.

The consequences of the suspension also include a non-contact order with the petitioner, meaning the boys cannot be in any classes together. Herzer mentioned that they would need to meet with school administrators to figure out a corrective action plan.

Seth Wolf, one of the parents, expressed his frustration to 7News, indicating that he felt the decision was misguided. He pointed out that it was a developmental issue.

Another parent, Renae Smith, also voiced her anger, sharing that their family had already withdrawn their child from the school and moved out of Virginia. “We’re facing a situation where they are labeling my son responsible for harassment and discrimination,” Smith remarked, expressing concerns about the lasting effects this decision could have on her child. It’s troubling, she added, and it should raise alarms for all parents.

Both parents believe LCPS is sending a message that any student who expresses dissenting views against Policy 8040 will face punishment. This policy, adopted in 2021, allows students to use facilities that match their gender identity rather than their biological sex.

Wolf commented on the dynamic, suggesting that the school system imposes its beliefs while disregarding the views of others. “What they’re doing to our kids is just cruel,” Smith added.

Virginia Attorney General Jason Miyarez has gotten involved, even accusing LCPS of mishandling the situation. It’s unclear if the third student involved will face a similar suspension. Miyarez pointed out that the footage does not depict any overtly discriminatory behavior but shows the boys simply asking students to leave.

The video itself, recorded by a transgender student, raises questions about privacy, especially since filming in locker rooms is generally prohibited. However, LCPS officials clarified that the footage did not violate privacy laws, given that no compromising situations were evident.

Moreover, LCPS has not commented on individual student matters publicly. A spokesperson mentioned that they have a thorough process for Title IX investigations.

The Freedom Law Centre, representing the affected families, stated they will continue to pursue a legal challenge until the decision is overturned. They firmly believe the boys have done nothing wrong and deserve to be viewed as innocent.

This case is not the first time Loudoun County has faced scrutiny. The district gained national attention in 2021 when a father was arrested for addressing a school board over an alleged sexual assault involving a transgender student.

Additionally, LCPS has invested $11 million into gender-neutral, single-occupancy restrooms in several schools within the district. Cobb, a representative for the Freedom Law Centre, criticized the school system’s repeated failures to act justly and expressed concern over the harm done to students in favor of ideological commitments.
