Courts Abandon $500 Million Private Fraud Penalty
The New York Court of Appeals has overturned a substantial civil fraud penalty against former President Donald Trump. This decision came after an appeal from Trump in a significant case initiated by New York Attorney General Letitia James.
The court found the earlier $500 million penalty excessive, determining it violated the Eighth Amendment. In fact, all five judges agreed on Trump and his company being liable but supported James’s authority to exercise injunctive relief to regulate Trump’s business practices.
What’s interesting is that while the liability remains, the financial penalty previously set at $364 million, plus interest, is now eliminated. Trump seems to be relishing this outcome, declaring it a “complete victory” over both James and former judge Arthur Engoron.
Trump stated, “This is a complete victory against the fake state attorney general, Letitia James!” He expressed appreciation for the courts reversing what he termed an “illegal decision” that allegedly harmed businesses in New York. He argued that the total damages, including interest and penalties, could have exceeded $550 million and characterized the case as a campaign of harassment.
Additionally, he framed this situation as politically motivated, voicing confidence in Judge David Friedman, who noted the case’s political undertones should lead to its dismissal. Friedman stated that James’s intent appeared to focus more on political gain than any genuine concern for business ethics.
He was critical of James’s application of a specific enforcement act, suggesting it granted her unusual power to target political adversaries. Friedman pointed out that the business transactions involved sophisticated parties that incurred no harm to the public and advocated for reversing the ruling entirely.
As the legal battle unfolds, the case may head to New York’s highest court given the split opinions on liability. Background-wise, Letitia James has been vocal against Trump since her campaign, pledging to probe into his business dealings.
Now, the Justice Department has stepped in, launching an investigation into James, further complicating the political landscape surrounding this case. It appears there are also accusations directed toward James, claiming she misrepresented her residences for loans, which she attributes to what she calls a “vengeance tour” led by Trump.
