Legal Challenge Over Illinois Immigration Law

Attorney General Pam Bondy is making efforts to challenge a new Illinois law that allows financial aid, including scholarships, to illegal immigrants. This legislation was recently signed by the Democratic governor of Illinois.

On Tuesday, the Department of Justice (DOJ) announced that it has filed a lawsuit against the state in the Southern District of Illinois. The complaint identifies Governor J.B. Pritzker, Attorney General Kwame Raul, and the board of trustees at Illinois State University.

The DOJ argues that the state is contravening federal law by providing financial aid to individuals who are not legally present in the country. They claim that this policy discriminates against U.S. citizens and is unconstitutional.

In their lawsuit, the DOJ states, “Federal law prohibits the provision of benefits to non-legally residing aliens in the United States, as long as comparable benefits are available to U.S. citizens, regardless of their residency status.”

According to the complaint, the Illinois law represents a “blatant and ongoing violation of federal law.”

Concerns Over Illegal Immigration Policies

Stephen Weinhof, the U.S. Attorney for the Southern District of Illinois, remarked that Illinois appears to be pursuing a “race to the bottom” by positioning itself as a leading sanctuary state.

Weinhof criticized the state’s policy for requiring in-state tuition and financial aid for illegal immigrants, asserting that it violates federal law and could encourage further illegal immigration at the expense of taxpayers. “Residents of Illinois deserve better,” he stated.

Bondy added that the DOJ has filed numerous lawsuits to ensure that U.S. students are not treated as second-class citizens, highlighting Illinois’ persistent defiance of federal law.

In response, a spokesperson for Governor Pritzker told Fox News Digital that this lawsuit represents another effort to deny Illinoisans access to vital resources and opportunities.

“While the Trump administration is removing federal resources from Americans, Illinois ensures all students, including immigrants, have access to educational support,” the spokesperson stated, emphasizing that the state’s policies align with federal law.

Financial Aid Bill Signed into Law

In August, Governor Pritzker signed a bill aimed at expanding financial aid to all residents of Illinois, regardless of immigration status. This legislation allows illegal immigrants to receive educational benefits.

The bill is presented as a means to create equality in financial aid and opportunities among all students in Illinois.

It specifies that students from Illinois who do not qualify for federal financial aid will still be eligible for state financial assistance, including cases involving various educational needs.

However, this law has stirred significant backlash among local parents. Michelle Cunney, a parent and education advocate, referred to the law as a “nightmare” in an interview, expressing her concerns about its implications for families.

“Honestly, it’s alarming to consider how this affects our children’s education and the costs that we, as taxpayers, will bear,” she said, voicing the anxiety many parents share.

According to her, under Pritzker’s leadership, it seems illegal immigrants could access resources and opportunities that legal residents struggle to obtain.

A spokesperson for Attorney General Raul’s office mentioned that they are reviewing the situation but did not provide further comments.
