DC Attorney General Files Lawsuit Against Trump’s Actions

On Thursday, DC Attorney General Brian Schwarb announced that he has filed a lawsuit aimed at challenging the Trump administration’s aggressive stance in Washington, D.C. This comes amid concerns about the federal government’s intervention in local law enforcement.

According to the provisions of the District of Columbia Home Rules Act, President Donald Trump could assume emergency control over police forces for a period of 30 days, starting August 11. Following this, Secretary of Defense Pete Hegses indicated that soldiers and airmen could carry weapons in D.C. if it was necessary for their missions.

Schwarb expressed strong opposition, stating, “Armed soldiers should not crack down on American citizens on American soil.” He emphasized this in a recent announcement.

He pointed out that the Posse Comitatus Act forbids military engagement in domestic law enforcement, claiming the national security measures in effect are a direct violation, as they involve military personnel operating under command in D.C.

Schwarb described the situation as “clearly illegal” and warned that it jeopardizes democracy and civil liberties. In response, White House spokesperson Abigail Jackson defended the President’s actions, stating that Trump is well within his rights to deploy the National Guard in D.C. for protecting federal properties and assisting law enforcement. She framed the lawsuit as an obstruction to efforts aimed at reducing violent crime.

The March deadline for the federal control period is approaching, yet Vice President JD Vance has hinted that the operation might be extended, pending congressional approval. Schwarb raised concerns over the indefinite nature of the deployment and noted that additional troops have recently been sent to the capital.

Following an executive order that expanded the National Guard’s role in domestic law enforcement, specialized units were formed to help maintain public safety in D.C. Schwarb cautioned that transitioning out of this state could lead to further relocations of troops.

He remarked, “The harm to the district is immeasurable.” According to him, the National Guard operates without legal authorization or proper training for law enforcement, which leads to confusion and erodes the trust needed between police and the communities they serve.

Schwarb further claimed that the presence of armed troops is detrimental to public safety and local businesses such as restaurants and hotels. He insisted that the rules governing D.C. must be followed and that the illegal deployment of the National Guard should be halted. “Our country was founded on principles of freedom and autonomy,” he stated, stressing that cities should not endure military occupation against their will.

The lawsuit has garnered support from various political figures, including California Governor Gavin Newsom and Los Angeles Mayor Karen Bass, particularly after a federal ruling regarding federal intervention in local situations.

This dispute is not the first, as there have been attempts to block federal control over the Metropolitan Police Department following another lawsuit filed earlier in August.
