Judge Barrett Discusses Universal Injunctions and Justice Jackson

On Thursday, Judge Amy Coney Barrett shared her thoughts on the contentious views surrounding universal injunctions, stressing that Justice Ketanji Brown Jackson is a fitting figure in this debate.

During an exchange with Barriweis from the Free Press, Barrett mentioned that she aimed to “set the calibration right” in a major opinion she penned back in June.

“I found Judge Jackson’s argument compelling; he used strong language that seemed justified,” Barrett remarked.

Barrett, appointed by Trump, made these statements while at Manhattan’s Lincoln Center, which is part of her promotional tour for her new book, “Announcement,” coinciding with the end of the Supreme Court’s session.

“I don’t think of myself as particularly spicy, but I guess being from New Orleans means you can appreciate some Tabasco from time to time,” she joked regarding her stance on the injunctions.

These comments were in response to questions about the emergency order, which has seen the Court block attempts to impose injunctions on government actions.

Such injunctions, particularly highlighted in the case Trump vs. Casa, have stirred debate, especially as judges regularly halt key policies from the Trump administration, with the Supreme Court often overturning these decisions.

In her opinion against a universal injunction, Barrett criticized Jackson for allegedly perpetuating an “imperial judiciary” and advised people not to dwell too much on her colleague’s objections.

While addressing a full auditorium, Barrett expressed her profound respect for Jackson, clarifying that her critiques weren’t personal.

“We just have differing views about the extent of jurisdiction,” Barrett explained.

“I’m critical of ideas, not individuals,” she emphasized, crediting the late Judge Antonin Scalia for that perspective.

Barrett, known for her meticulous approach, noted that despite differences in opinion, she maintains friendly relations with her colleagues.

When asked to summarize each justice’s role in a single word, Barrett responded promptly for Chief Justice John Roberts. She described Judge Neil Gorsuch as “goes west,” and tagged Judge Brett Kavanaugh as “sports.” However, she hesitated a bit before labeling Jackson as “Actor, Broadway.”

Overall, Barrett’s comments reflect ongoing discussions about the judiciary’s role and how different justices interact amidst legal disagreements.
