This decision from the High Court follows an emergency petition from the Trump administration, which has faced considerable legal scrutiny, as the dismissal has been met with challenges in court.

A Court of Appeals’ Response

In a related note, a Court of Appeals may prevent Trump from firing FTC Commissioners, raising questions about the boundaries of presidential power. This situation is particularly sensitive, considering it involves a legal precedent.

Interestingly, Massacre’s case was revived by the district court during the appeals process, and she was reinstated on September 2. After her return, she shared her thoughts on social media, reflecting on the recent turmoil.

Trump’s decision to dismiss not only Massacre but also another Democrat commissioner, Alvaro Bedoya, has sparked concerns over the implications under the FTC Act.

These developments conflict with the well-established Supreme Court ruling from the 1930s in Humphrey’s Executor v. United States, which deemed such firings illegal for an FTC committee member appointed under Franklin D. Roosevelt’s administration.

While the Supreme Court has temporarily allowed the dismissal within independent institutions, the case raises critical questions about whether the current conservative majority may shift or modify long-standing decisions like the one in Humphrey’s case.
