Senate Republicans Criticize Biden Administration’s Use of Autopen for Pardons

Senate Republicans have accused former President Joe Biden and his administration’s lead executive of undermining the constitutional framework surrounding pardons. A letter addressed to Attorney General Pam Bondi highlighted what the Republicans describe as “core constitutional requirements” crucial for granting pardons. They claim the current administration’s use of automated signatures might have actively contravened these standards.

During his last months in office, Biden’s administration commuted the sentences of approximately 1,500 prisoners and granted pardons to 39 individuals in December. In a swift timeframe of just over a month, around 2,500 commutations were issued.

Senator Ted Cruz, who serves on the Senate Judiciary Committee, expressed his concerns about the process. He indicated that the pardons were issued with a lack of rigorous case-by-case evaluation and were, at least partially, signed with an autopen by Biden.

Cruz stated, “These constitutional standards were effectively eroded in the waning months of the Biden administration due to personal motivations among Biden, his family, and his close staff.” He emphasized that the Presidential Pardon Authority, as outlined in Article 2, Section 2 of the Constitution, demands some degree of oversight.

A senior official from the Biden administration also seemed to question the processes behind these pardons and their reliance on autopen usage. Cruz further pointed out that confidence in the amnesty process is essential for all parties involved, including government officials, the recipients of pardons, and the general public.

However, ongoing Congressional inquiries and various reports have raised doubts about whether Biden explicitly directed the expansive grant of pardons. An email uncovered by Axios revealed that some Biden officials had expressed concerns regarding the decision-making process for these pardons and the frequent use of the autopen.

Cruz remarked that this situation appears to distance the president from those actually signing the pardons. He raised the point that it wasn’t clear whether these actions were taken under the president’s direction or based on some set criteria.

Additionally, Cruz asserted that the suspicions surrounding this matter could lead to a constitutional crisis, eroding public trust in the legal validity of the president’s amnesty powers. He emphasized the need for accountability, stating that if the integrity of the pardon process is compromised, those complicit should be held accountable.
