Court Rules that Michigan City's Decision Not to Display LGBTQ Pride Flags is Constitutional

Hamtramck Flag Policy Upheld by Federal Judge

A federal judge has dismissed a lawsuit against the city of Hamtramck, Michigan, regarding its recent policy that bans all private flag displays.

In June 2023, the Hamtramck City Council passed a resolution that restricts which flags can be flown on city property. According to this policy, only five types of flags are permitted: the U.S. flag, the Michigan state flag, and a flag representing the community’s international character. All other flags, specifically those linked to religious, ethnic, racial, political, or sexual orientation groups, are prohibited.

This decision led to accusations that the city was infringing on freedom of speech. However, U.S. District Judge David Lawson ruled against the claims on Monday. He explained that Hamtramck’s actions were constitutional, emphasizing that they were not singling out the pride flag but instead banning all private flag displays.

The judge stated, “Hamtramck’s refusal to display the gay pride flag was not in violation of the constitution,” reinforcing that the city council’s policy aims for neutrality.

Notably, about 40% of Hamtramck’s residents are foreign-born. The city council, composed entirely of Muslim members, argued that flying the pride flag conflicts with their religious beliefs.

In their defense, the council said, “This council believes in neutrality, the rule of law for this community, especially our residents,” following the recent resolution.

After the policy’s implementation, two members of the relationship committee were removed from their roles due to their decision to fly the LGBTQ Pride flag on city property. Mayor Amer Ghalib addressed the issue, stating that the policy does not target specific groups.

Ghalib remarked in 2023, “We’re not targeting anyone.”
