Supreme Court Allows Trump Administration to Withhold $4 Billion in Foreign Assistance

Supreme Court Allows Curbing of Foreign Aid Fund

The Supreme Court has authorized the Trump administration to restrict a $4 billion foreign aid fund. This decision came after a temporary suspension of a ruling by District Judge Amir Ali, who was appointed by Biden, which had directed the administration to distribute billions in foreign aid by early September.

The Supreme Court’s order indicated that the potential harm caused by enforcing Ali’s decision seems to outweigh the possible harm faced by those opposing the order. The court noted that this ruling should not be interpreted as a final verdict on the matter. Rather, it reflects initial viewpoints aligned with standards for temporary relief.

In dissent, Judge Elena Kagan highlighted that the request raises significant questions about the relationship between the president and Congress. Kagan, along with Justices Sonia Sotomayor and Ketanji Brown Jackson, expressed concern that the ruling effectively allows Congress to compel the administration to allocate the $4 billion for foreign aid, which may not reach its intended beneficiaries now.

The Trump administration had previously claimed that Ali’s orders posed a serious threat to the separation of powers. They were under pressure to allocate funds canceled by Trump through what is referred to as the “Pocket Recession” by September 30th.

To comply in a timely manner, administration officials would need to engage in immediate foreign and diplomatic discussions regarding the use of these funds. The President has informed Congress about the adverse effects of foreign policy, expressing strong opposition to the current situation.
