The U.S. Department of Education is taking action against Fairfax County Public Schools in Virginia due to reports that school staff facilitated abortions for students without notifying or obtaining consent from parents.
An August report revealed that social workers at the school arranged and funded abortions for 17-year-old students during the 2021-2022 school year without parental consent. Additionally, another pregnant student was allegedly pressured into having an abortion, told that “there is no other option,” though she ultimately chose not to go through with it.
In a statement released Monday, the Department of Education indicated that it is requiring the district to conduct a thorough investigation into the claims and provide proof of compliance with the Protection of Pupil Rights Amendment (PPRA), which safeguards certain rights for students and parents, including notifications and opt-out opportunities for non-urgent physical examinations.
Candice Jackson commented, expressing shock over the situation, stating that school officials appear to have misused their position of trust to promote abortion services without parental knowledge or consent. She emphasized that children belong to their families, not the government, and such actions are morally questionable and illegal.
Jackson also mentioned that the previous administration seemed slow to address these kinds of issues, asserting that swift action is necessary to restore parental authority regarding the well-being of children.
The Department of Education has requested that FCPS provide written responses by October 17, including:
- A copy of the general notices to parents about their rights under the PPRA for the years 2021-2022 to 2025-2026.
- Copies of policies related to non-urgent, invasive physical examinations for the same time period, including how parents were consulted in developing these policies.
- Documents regarding communication, directives, or training given to staff about handling sensitive medical services, such as abortion referrals.
- Records of any incidents of school staff promoting abortion services to minors.
- A statement regarding whether federal education funds were used for sensitive health services, including abortion referrals.
Following the report, FCPS announced it has begun its own investigation into the allegations. Virginia Governor Glenn Youngkin has directed state police to open a criminal investigation, voicing concern that public funds may have been misused for a student’s abortion. Senator Bill Cassidy has also requested answers from the district regarding these claims.
In response to inquiries, FCPS stated that it welcomes the opportunity to answer the Department’s questions based on an ongoing review of the claims from 2021. They reiterated that such practices are not acceptable in Fairfax County public schools and expressed commitment to cooperation with both the state police and the Department of Education investigations, while focusing on ensuring a safe and supportive environment for students.
Under Virginia law, parental consent and notification are required before minors can obtain an abortion.
