Appeals Court Supports Trump’s National Guard Deployment in Portland
A panel of judges from an appeals court has determined that President Donald Trump is authorized to deploy the National Guard to Portland in order to secure federal facilities facing unrest.
Activists, particularly those opposing deportation, have been holding frequently violent protests at the Immigration and Customs Enforcement facility located in the South Waterfront area. The president maintained that sending military forces was vital to restore order and protect the site.
“The U.S. Constitution and the Supremacy Clause back the president’s authority to safeguard the public and law enforcement, and today’s decision proves us right,” a statement asserted.
On Monday, the Ninth Circuit Court of Appeals ruled in favor of the military deployment, despite arguments presented by the Justice Department and state officials against it.
Local and state representatives contended that the military presence was unwarranted, suggesting that the federal government was exaggerating the level of violence at the facilities in question.
Some lawmakers even accused the administration of fabricating incidents to justify such actions. Democratic Senator Jeff Merkley from Oregon remarked, “This is the first occasion I’ve witnessed where the federal government seems to have orchestrated a riot to invoke the Insurrection Act.”
He further commented, “Despite the illegal federalization of the Oregon National Guard—blocked because there is no actual ‘invasion’ or ‘insurrection’ in Portland—Trump is persistently trying to provoke riots and violence.”
Critics on the left have voiced concerns that the president is leveraging the military to exert control over urban areas and intimidate dissenters.
California’s Democratic Governor Gavin Newsom stated, “This isn’t about public safety. It’s about power. The president is using the military as a political tool against the American populace. We plan to challenge this in court, but silence is not an option against such reckless behavior.”
The panel’s decisions included two judges appointed by President Trump and one appointed by President Bill Clinton.
Meanwhile, Secretary of Homeland Security Kristi Noem expressed approval for the ruling on social media, claiming it as a “victory for the safety and security of the American people.”
“The Ninth Circuit confirmed that the president exercised his constitutional right to direct the National Guard to protect federal assets and ensure public safety in Portland,” she noted.
