Judge Appointed by Clinton Prevents Trump Administration from Eliminating Gender Identity in Sexual Education

Oregon Judge Blocks Federal Cuts to Sex Education Funding

An Oregon judge, appointed during the Clinton administration, has put a stop to the Trump administration’s efforts to revoke funding for sex education in states that include gender ideology in their curricula.

In September, sixteen states led by Democrats, along with the District of Columbia, filed a lawsuit against the Department of Health and Human Services (HHS). The lawsuit claimed that the administration’s plan would defund programs for states that did not align with President Trump’s executive order, which asserts that the federal government only recognizes two genders. U.S. District Judge Ann Aiken issued a preliminary ruling that is indefinite, stating that HHS had unlawfully imposed new conditions on funding that Congress had already approved, thus violating the principle of separation of powers.

HHS has defended its stance, arguing that the goal is to “protect children from indoctrination with false ideologies.” However, the judge’s ruling highlighted concerns from the plaintiff states that the true motivation behind HHS’s requirements is to marginalize transgender and gender-diverse individuals in educational materials. The order suggests that the actions are consistent with hostile comments from the current administration regarding transgender issues.

HHS did not provide any comments upon request.

Washington Attorney General Nick Brown noted in a statement that the judge found HHS’s policy to be stigmatizing and harmful to mental health among vulnerable youth, emphasizing the need for an immediate injunction to prevent such actions.

There are ongoing discussions about how sex education programs have been influenced by various organizations, leading some to argue that they perpetuate a belief that biological sex is not a reality.
