Sean “Diddy” Combs may soon be the focus of a new criminal investigation. This comes after accusations that he allegedly forced a male music producer to engage in unwanted sexual acts. These events reportedly took place after he was seen masturbating with a shirt once worn by the late rapper Biggie Smalls, which he then threw at his accuser.
According to recent incident reports examined by the Post, the alleged victim, Jonathan Hay, approached law enforcement in late September. He reiterated claims made in an earlier civil lawsuit, alleging that Combs compelled him to perform oral sex. Hay described Combs’ penis—previously referred to as a “big Tootsie roll” by a female accuser—as measuring approximately 4 to 5 inches during the incident.
“I am pursuing criminal charges against Combs at both state and federal levels,” Hay told an outlet recently. Earlier this month, he publicly identified himself as a plaintiff in the civil suit. He emphasized that Combs, who has a legal history involving sexual offenses, needs to be held accountable for his actions.
Diddy’s representatives did not respond promptly to requests for comments. Previously, Combs’ legal team has denied the allegations made by Hay.
Hay’s civil lawsuit filed in July outlines accusations of sexual assault against the hip-hop producer. In a recent interaction with law enforcement, after turning himself in to authorities in Los Angeles, police reached out to their counterparts in Largo, Florida, to assist in interviewing Hay, who claimed the assault occurred in Los Angeles.
He also mentioned that Biggie’s son, CJ Wallace, was involved in the incident, referring to Biggie’s alias, Notorious B.I.G. Requests for comments from Wallace went unanswered.
Biggie, born Christopher Wallace, was a key figure in Combs’ career until he was tragically shot in 1997.
Hay recounted that he was working with Combs and Wallace on a project in California when they visited a warehouse containing Biggie’s clothing in February 2020. Wallace wanted to take photos with the clothing for a donation to the Rock and Roll Hall of Fame. Allegedly, while Hay was looking through the clothes, Combs entered the room, started watching pornography on his phone, and masturbated under one of Biggie’s shirts.
The police reports state that Hay was stunned when Combs allegedly asked him to “finish him,” which he ignored. Combs allegedly ejaculated onto one of Hay’s shirts and threw it at him, saying “rest in peace.” Hay had kept the incident to himself for a long time, but eventually confided in Wallace in December 2020, which led to a brief conflict.
In early March 2021, when Hay visited California to meet Wallace and entrepreneur Willie Mack, he claims he was assaulted by the two men, who restrained him. Allegedly, Combs then barged in, accused Hay of being a snitch, and forced his penis into Hay’s mouth.
Hay’s account includes descriptions of being coerced, as he struggled against Combs. A woman in a separate lawsuit against Combs from over 20 years ago had similarly described his genitalia as a “big Tootsie Roll.” The Los Angeles Sheriff’s Department hasn’t confirmed whether they are investigating Hay’s allegations, but Largo police have confirmed the report is authentic and has been forwarded to another agency.
Hay stated that he hasn’t spoken to Wallace or others involved in the project since the alleged incident and has been dealing with depression and mental health struggles since then.
The disturbing claims parallel those made in Hay’s civil lawsuit from July, though he wasn’t initially named. Earlier this month, he revealed his identity as John Doe.
Currently, Combs is serving time at FCI Fort Dix, a low-security facility in New Jersey. In July, he was found guilty of two counts related to prostitution but was cleared of more severe charges like sex trafficking and extortion. Beyond this, he faces numerous civil lawsuits that accuse him of a pattern of sexual misconduct.
