Seventeen transgender members of the Air Force, discharged under the Trump administration’s policy against transgender service members, have filed a lawsuit against the federal government. Their aim? To reclaim the pensions and benefits that were stripped away following their involuntary early retirement.
These individuals had served between 15 and 18 years and are now seeking retirement benefits they should have previously received. The lawsuit, lodged on Monday, follows a recent announcement from the Air Force which stated that those who served within that timeframe wouldn’t have the chance to retire early and apply for benefits, reversing an earlier decision.
According to GLAD Law, an advocacy group involved in the lawsuit, not only did these service members lose their health insurance, but they could potentially see a loss of up to $2 million in compensation throughout their lifetimes due to this new policy.
Michael Haley, the attorney for the plaintiffs, described the withdrawal of early retirement benefits as part of a broader pattern of discrimination against transgender individuals. Several of those suing have already received orders for severance, and some have begun the discharge process. “These are people trying to get on with their lives, only to have their plans abruptly halted,” he noted.
One plaintiff, a sergeant major who served for 15 years, including a deployment to Afghanistan, joined the lawsuit after being denied early retirement. He expressed his frustration, saying, “The military taught me to lead and fight, not retreat.”
Logan Ireland, another plaintiff, criticized the decision, claiming that the removal of retirement benefits signals that those values of support and respect apply only in combat situations, not when service members truly need them.
This legal action is just the latest in a series of challenges against the administration’s policy that has systematically removed transgender service members from the armed forces. Earlier this year, the U.S. Supreme Court allowed the enforcement of the ban on transgender soldiers to proceed amidst ongoing legal challenges.
In addition, it seems that the efforts from President Trump and Pentagon Secretary Pete Hegseth aim to diminish diversity, equity, and inclusion initiatives within the military.
In August, beyond the withdrawal of retirement benefits, the Air Force made a decision to deny transgender service members the chance to appeal to a peer committee for their continued service rights. Following suit, the Pentagon has now implemented a similar policy across the military.
