Senate Republican Investigates Compliance with Title IX Changes

The leading Senate Republican has initiated an investigation into over a dozen blue states to examine their adherence to President Donald Trump’s executive order which seeks to prohibit men from participating in women’s sports.

Senator Bill Cassidy (R-Louisiana) is focusing on educational institutions nationwide that may be in violation of Trump’s directives. This order aims to reverse modifications made during Joe Biden’s presidency to Title IX, a long-standing law against sex discrimination in educational programs receiving federal funds.

Cassidy’s inquiry centers on the participation of transgender athletes in women’s sports, as well as policies surrounding shared facilities like locker rooms and bathrooms.

Recently, 130 Democratic Congressional Representatives have urged the Supreme Court to support transgender athletes in a legal dispute involving Title IX.

In his investigation, Cassidy is scrutinizing 18 states and Washington, D.C., questioning whether federally funded schools are complying with the recent changes to Title IX. His research spans states including California, Colorado, and New York, among others.

In 19 letters sent to various state leaders and the Department of University Education, Cassidy criticized many institutions for mixing male and female athletes and pushing policies that allow sharing facilities.

He stated, “According to the current correct interpretation of the law, this is a clear violation of Title IX.”

The timing of Cassidy’s investigation is crucial, as the Supreme Court is currently deliberating a couple of cases that could significantly impact Title IX enforcement nationwide, particularly regarding the participation of biological males in women’s sports.

Cassidy, who chairs the Senate Health, Education, Labor and Pensions Committee, indicated that the Biden administration’s revisions to Title IX—including redefining sex to encompass gender identity—are viewed as illegal changes that compromise protections for female athletes.

Trump’s executive order, issued earlier this year, reinstated Title IX to its 2020 form and mandated that the Department of Education and its Office of Civil Rights ensure that strict definitions around gender—recognizing only male and female—are upheld. Cassidy noted that ensuring compliance is essential for providing women and girls equal opportunities in both sports and education.

Furthermore, Cassidy has requested state education agencies and universities to supply information for the investigation by December 8. This includes state and institutional Title IX policies concerning gender identity, protections for biological females, adherence to Trump’s order, new definitions of gender, and any complaints from students regarding shared spaces.
