Justice Department files lawsuit against Virginia school board after Christian students are suspended due to gender policy

Justice Department Accuses Virginia School Board of Violating Students’ Rights

The Justice Department has claimed that a school board in Virginia infringed on the constitutional rights of two Christian students by enforcing a gender identity policy. This policy reportedly punished these students due to their religious beliefs.

According to the Department of Justice, the Loudoun County Board of Education suspended two boys from Stonebridge High School for ten days after an incident in the boys’ locker room. A female student allegedly entered the locker room and recorded both audio and video of the male students present.

Various boys spoke out about this situation, including the two Christian students whose beliefs dictate the use of biologically accurate pronouns and single-sex facilities, which is part of the complaint filed.

Loudoun County is said to have implemented Policy 8040, which requires students and staff to “accept and promote gender ideology,” regardless of personal religious beliefs.

The complaint asserts that the plaintiffs were placed in a position where they had to choose between adhering to their personal beliefs and conforming to the school’s policies.

The lawsuit details that school officials accused the two boys of “sexual discrimination” and “sexual harassment.” As a result, they were suspended and required to follow a “comprehensive student support plan,” as stated by the Justice Department.

The Justice Department argues that the school board’s actions violated the boys’ rights under the Equal Protection Clause of the Fourteenth Amendment.

Assistant Attorney General Harmeet K. Dhillon emphasized that “Students do not waive their First Amendment rights at the school gates.” She criticized Loudoun County’s policy for undermining the rights of religious students who cannot embrace concepts that contradict biological realities.

As of now, the Loudoun County School Board has not responded to requests for comments regarding this lawsuit.
