Sen. Mark Kelly is unsure about labeling Trump's actions in Venezuela as 'illegal'

Sen. Mark Kelly’s Stance on Military Action in Venezuela

Senator Mark Kelly (D-Ariz.), who earlier made headlines with a video encouraging military personnel to reject what he deemed “unlawful orders,” hesitated on Tuesday to label the recent U.S. military strike in Venezuela as “illegal.” This ambivalence stood out, especially as several of his fellow Democrats were vocal in their condemnation of the operation.

Last weekend, President Donald Trump reported a successful mission in Caracas, which allegedly included the capture of Venezuelan President Nicolas Maduro and his spouse. In response, many progressive Democrats criticized the action, arguing that it constituted an impeachable offense.

During an appearance on CNN’s “The Lead with Jake Tapper,” Kelly didn’t fully align with those criticisms. When pressed about his previous statements and the legality of military orders, he noted, “Military personnel must assess if orders are lawful or not. This is a constitutional issue.” He seemed to imply that while he recognized Maduro as a problematic leader, the circumstances around Trump’s approach raised complex legal questions.

“Maduro’s definitely a bad figure, and it’s good that he’s no longer in power. But it seems like there was no real strategy after taking him down,” Kelly commented. He referred to the installation of Delcy Rodriguez, whom he described as Maduro’s deputy, suggesting that the U.S. had not prepared adequately for the aftermath of the operation.

Kelly was one of a small group of Democrats featured in the viral video, which encouraged military members to “refuse illegal orders.” Yet, alarming as it might sound, they haven’t explicitly pointed to examples of such orders that they believed were issued.

In a related development, Secretary of the Army Pete Hegseth announced a formal censure letter directed at Kelly, indicating that he would be under scrutiny regarding his rank and retirement pay. He emphasized the importance of maintaining military discipline and accountability.

In a statement, Hegseth criticized Kelly’s previous video, suggesting it was intended to disrupt military order and discipline, underscoring the expectations surrounding military justice.
