Bay Area doctor delays trial against restaurant over spicy appetizer due to unusual circumstances

A doctor from San Jose is suing a Thai restaurant in the Bay Area, claiming that the spicy food they serve is “unfit for human consumption.” The case has been postponed so that the doctor can go to a wedding in Vietnam.

Harjasleen Walia, a neurologist from Los Gatos, filed the lawsuit against Ku De Tai, stating that one of their Dragon Ball appetizers caused her to burn her vocal cords. She requested to move her trial date from March 23 to November 9 to accommodate her travel plans. Upon returning from the wedding, she mentioned that she needs to look after her elderly parents as well.

In her lawsuit, Walia argues that the Dragon Ball appetizers were unsafe, alleging that the staff was not prepared to handle her severe reaction. She claims that despite ordering a “mild” version, the food caused chemical burns to her throat, nose, and esophagus.

The fiery appetizer features Thai chili peppers that can have a heat rating between 50,000 to 250,000 on the Scoville scale. As a comparison, a jalapeño typically ranges from 2,500 to 5,000 units.

Walia states that after consuming the dish at Ku De Tai, she fell critically ill and required medical attention for her injuries. Her legal team contends that her injuries are permanent and will lead to lasting physical complications due to being served unsafe food.

She is seeking significant damages for medical costs, lost earnings, and legal fees, among other things.

Furthermore, the complaint critiques the restaurant’s promotional tactics, asserting that Ku De Tai targets spice enthusiasts. They market their food as an adventure for the senses, claiming it delivers “fireworks” to patrons’ palates and offers an authentic “Thai” experience.

However, restaurant managers have refuted the allegations, stating that the Dragon Ball does not contain excessive chili peppers and asserting that they have never received complaints about this dish causing health issues.
