Legal Accountability in Gender Transition Cases

We’re at a juncture where legal actions may be the only means to address the harm caused by medical professionals in the realm of gender affirmation.

Recently, Fox Varian, a 22-year-old, successfully sued the doctors involved in his transition from female to male, winning $2 million. Now, he is living as a woman again, but, sadly, the physical changes have remained irreversible.

This lawsuit is a significant development, representing the first instance where individuals behind a medically-supported, ideologically-driven process are held accountable. At least 28 similar lawsuits are in the pipeline.

“I suspect many of the issues raised in her case are common across various situations: inadequate collaboration and insufficient training,” Varian’s attorney, Adam Deutsch, remarked. “Knowing that a jury recognized the doctors’ responsibility in this situation is something that should resonate with all medical practitioners.”

This lawsuit raises serious questions about a medical system that has thrived on the struggles of young individuals without considering if minors should be making such significant decisions about their bodies long before they can legally consume alcohol.

When he was 16, Varian identified as male. Dr. Simon Chin, a surgeon based in Westchester, removed Varian’s healthy breasts in 2019, less than a year after he had gone through various identities. This procedure was enabled by the argument from Varian’s attorney that psychologist Kenneth Einhorn played a pivotal role in his transition.

In the Westchester County Supreme Court, it was contended that the psychologist and surgeon failed to uphold the standard of care that would have prevented significant trauma and complications arising from the surgery.

“This case isn’t about ideology,” Deutsch stated. “It’s centered on medical malpractice. Every patient deserves care that meets established standards.”

Varian’s legal team claimed that Einhorn introduced “ideas” into Varian’s mind following his expressions of gender dysphoria.

Varian’s mother, Claire Deacon, voiced her concerns: “I found the psychologist overly aggressive, possibly coercive in steering the decisions.” She also mentioned feeling pressured into consenting to the surgery after being led to believe her daughter was at risk of suicide.

Varian’s lawyers argue that various mental health challenges, such as anxiety and social phobia, were overlooked during the treatment process.

Dr. Chin is said to have met with Varian for only two short sessions before performing the mastectomy.

“These situations are intricate… and it’s vital that professionals in this field are appropriately trained,” Deutsch noted. “Fox is thankful for the chance to seek justice in court, demonstrating that these practitioners fell short of care standards.”

A jury ruled in favor of Varian on January 30, granting her the $2 million settlement.

Varian’s journey back to living as a woman occurred three years after the procedures, but the changes to her body are irreversible.

She expressed the emotional toll of permanent disfigurement: “No amount of reconstruction can truly restore what I’ve lost.”

The jury’s verdict should prompt serious concerns among doctors who readily provide significant medical interventions to young patients facing gender-related psychological issues.

We need to question why doctors, cultural influences, parents, and institutions encourage minors—who we generally agree aren’t capable of making weighty life choices in other contexts—to pursue permanent solutions for what might just be temporary difficulties.

The ongoing discussions around transgender issues are polarizing, detracting from a crucial concern: the wellbeing and bodies of our youth.

This lawsuit transcends gender theory; it’s about ensuring medical professionals are accountable when they fail those vulnerable children who depend on them for support and guidance.
