Mark Gastineau’s Lawsuit Against ESPN Dismissed

Mark Gastineau, the iconic Jets player known for his impressive sack record, is facing a setback in his legal battle with ESPN. He had been seeking $25 million in damages over the network’s use of footage where he confronted Brett Favre.

Gastineau, who held the single-season sack record until Michael Strahan surpassed it in 2001, saw his lawsuit dismissed by a judge. The ruling stemmed from the fact that Gastineau had previously given consent for the use of his name and likeness in relation to the film and its promotional content.

This footage was part of the ESPN documentary, New York Sack Exchange, which highlighted the legendary Jets pass rush from the 1980s, and was included in the 30 for 30 series.

Judge Paul Engelmayer noted that the interaction between Gastineau and Favre, which delved into a prominent NFL record, was significant to the film’s narrative. He pointed out that Gastineau’s assertive demeanor in the footage seemed to have impacted the dynamics within the sack exchange group featured in the documentary.

In the aired video, Gastineau confronts Favre, who was the Packers quarterback during Strahan’s record-breaking moment, accusing him of deliberately allowing Strahan to take him down. “When you fell for him…you really hurt me. You hurt me, Brett,” he expressed.

While Favre hasn’t directly denied assisting Strahan in breaking the record, he has asserted that he never intended to cause Gastineau any harm. “I may have thought about helping Strahan,” Favre stated in a post on social media last year, “but I never thought about hurting Gastineau.”

Gastineau argued that ESPN aired the footage without Favre’s consent and neglected to show the part where the two shook hands, which he claims led to significant backlash from fans.

Favre later mentioned he understood how Gastineau might feel differently about his legacy, highlighting the impact of such records on athletes’ reputations and marketability. “Becoming Sack King would have boosted his appeal at card shows and helped his Hall of Fame chances,” he reflected. “The business side of football has evolved significantly since our playing days.”

During his career with the Jets from 1979 to 1988, Gastineau recorded a total of 107.5 sacks.
