Trump administration files lawsuit against Harvard for supposed civil rights abuses and antisemitism

Trump Administration Sues Harvard Over Anti-Semitism Claims

The Trump administration has initiated legal action against Harvard University, alleging violations of the civil rights of Jewish students.

This lawsuit, which was submitted in U.S. District Court in Massachusetts early Friday, accuses Harvard of not safeguarding Jewish and Israeli students from anti-Semitic hostility and failing to implement effective anti-harassment policies. Following the October 7, 2023, attack by Hamas on Israel, Jewish and Israeli students reported instances of harassment, including stalking and physical assaults, such as being “spit on.”

“Jewish and Israeli students have endured a hostile educational environment for several years,” the legal document states. “They were repeatedly denied access to educational facilities by anti-Semitic demonstrators. Fearing for their safety, Jewish students wore baseball caps to hide their yarmulkes or sought to remain inconspicuous, effectively limiting their access to federally funded educational opportunities.”

The lawsuit claims that Jewish and Israeli students were subjected to severe and pervasive harassment, which is both discriminatory and offensive based on their race and national origin. Harvard has been accused of inadequately disciplining harmful conduct against these students, thereby breaching its own policies and federal regulations.

“Harvard University’s response to this is to do nothing,” the complaint asserts. “Its faculty and leaders turned a blind eye to anti-Semitism and discrimination against Jews and Israelis. Students and professors violated Harvard’s time, place, and etiquette rules with impunity, rules that Harvard has set and would enforce on everyone else.”

Other allegations mentioned include that Harvard leadership allowed instructors to cancel classes under pressure, permitted illegal demonstrations by students, and allowed anti-Israel protesters to occupy the school library for an extended period.

“Harvard University has been and continues to be intentionally indifferent to what the President’s Task Force on Combating Anti-Semitism and Anti-Israel Bias has termed the ‘exclusion of Israeli or Zionist students from social life and extracurricular activities,'” stated the filing.

As a recipient of federal grants, Harvard is expected to comply with Title VI of the Civil Rights Act of 1964, which prohibits discrimination based on race. The filing notes that Harvard is scheduled to receive over $2.615 billion in federal funding from the Department of Health and Human Services, among other sources. However, it is claimed that Harvard has violated Title VI through discriminatory practices against Jewish and Israeli students.

“Harvard University has defied federal law and violated Title VI by discriminating against Jewish and Israeli students. The university continues to breach its Title VI obligations,” the filing explains.

The Trump administration is seeking to recover federal funds disbursed to Harvard despite these alleged violations. Last year, Harvard filed its own lawsuit against the administration after it froze billions of dollars in federal funding, a case in which a Boston federal judge sided with the university, labeling the anti-Semitism claims as a “smokescreen.”

“Antisemitism is a serious problem and cannot be tolerated under any circumstances,” Harvard stated. “The university has taken substantial and proactive steps to address the root causes of anti-Semitism in our community.”

In recent months, the Trump administration has targeted several elite universities, alleging discrimination and an ideologically biased agenda. Many institutions have since reached agreements with the White House to restore previously frozen federal aid.
