School Clears Student's Record After Discipline for Pro-ICE Flyer

Student’s Suspension Over Pro-ICE Flyers Rescinded

A high school student in San Diego, California, who faced suspension for distributing pro-U.S. Immigration and Customs Enforcement (ICE) flyers, has had his record cleared.

At Torrey Pines High School, the student had expressed support for ICE by placing flyers that included the phrase, “We… [heart] ICE — Real Americans.” He stated that he believes in the mission of ICE and wishes for government officials to enforce U.S. immigration laws. He also wanted to counter the negative sentiments about ICE that he noticed among peers and faculty, according to reports.

School authorities characterized the flyers as containing “militant language,” deeming them “unacceptable.”

The Foundation for Individual Rights in Education (FIRE), a legal group, stepped in, arguing that the flyers had been displayed in areas where opposing viewpoints were also visible.

In a recent announcement, FIRE noted that its involvement prompted the school district to overturn the student’s suspension. They further mentioned that just weeks before the student shared his flyer, there had been a walkout by students protesting against ICE.

During that walkout, students held signs with messages such as “If you’re an ICE agent, your mother is a hoe!!,” “F*** ICE,” and “ICE is a different spelling of KKK,” according to FIRE.

Eventually, the suspension was lifted after the student obtained representation from a litigation attorney, FIRE reported.

Connor Fitzpatrick, a senior prosecutor at FIRE, commented that school officials cannot dictate which opinions students are allowed to voice. He emphasized that expressing offensive opinions does not constitute “harassment” or “intimidation” and is part of the democratic process in the U.S.

Fitzpatrick expressed satisfaction that the suspension had been revoked and noted that they would continue to monitor the situation to ensure the school’s adherence to First Amendment rights. He reaffirmed that public schools are obliged to let students express their political views peacefully.

School district leaders mentioned the supposed cancellation of the lawsuit against the student, as reported by some outlets.

Torrey Pines High School Principal Rob Coppo announced his resignation on March 12, requesting a reassignment within the San Dieguito Union High School District shortly after the suspension was issued.

In remarks, Coppo claimed it was “inaccurate” to say that students faced repercussions for their political views. He acknowledged awareness of claims suggesting he was stepping down due to the controversy but opted not to engage with the matter.

The San Dieguito Union High School District issued a statement asserting that no students had been disciplined for their political beliefs, emphasizing support for students’ rights to express their opinions. However, the district highlighted that there are rules concerning student conduct and campus safety, including policies against discrimination and harassment, which would be enforced fairly to ensure a safe learning environment.
