Prosecutors state that the Kirk murder case can move forward without DNA evidence

Suspected assassin of Charlie Kirk requests to prohibit cameras at upcoming hearing

Prosecutors Ready for Preliminary Hearing in Charlie Kirk Murder Case

Prosecutors in Utah have announced that they are prepared to move forward with a preliminary hearing against Tyler Robinson, who is accused of assassinating conservative figure Charlie Kirk. Significantly, this will occur without waiting for additional DNA analysis, according to a recent court filing.

In their filing submitted on a Friday, the prosecutors stated that linking Robinson to the crime through DNA evidence isn’t essential for holding a preliminary hearing. Instead, they believe there is enough other evidence to warrant proceeding. They conveyed their confidence by stating, “The state has previously offered that it intends to present DNA evidence… However, if the court determines that the State’s evidence warrants proceeding, we are ready to continue with the hearing as scheduled, regardless of the DNA evidence.”

As it stands, the preliminary hearing is set for May 18. Judge Tony Graf is expected to decide soon whether to stick to this date or postpone it.

Robinson’s attorneys had requested an extension back in late March, suggesting that they needed at least six more months to prepare. They mentioned that they’d received a staggering 600,000 files from the prosecution during a meeting, which understandably will take time to sift through. Their assertion was that the discovery process is still incomplete and complex.

In response to the defense’s challenges, especially related to a ballistics test, prosecutors contended that Robinson’s legal team was misleading the public. They pointed out crucial points omitted by the defense regarding the ATF’s findings on the bullet recovered during the autopsy.

Assistant Utah County Attorney Christopher Ballard expressed concerns that these claims have misrepresented the situation, leading to a lot of misleading media coverage. Robinson stands charged with multiple offenses, including aggravated murder, which could potentially lead to the death penalty.
