Former President Joe Biden has initiated a lawsuit aimed at preventing the release of a recorded interview. Critics believe that the disclosure could unveil evidence suggesting mishandling of classified information by Democrats.
The Heritage Foundation submitted a Freedom of Information Act request for the release of audio recordings and transcripts from a series of conversations between Biden and a writer in 2017, which led to the lawsuit.

Biden’s legal team argues that the push for these recordings is driven by political motives. A spokesperson for Biden, TJ Ducklo, emphasized, “The Justice Department itself has stated these tapes aren’t in the public interest. What we see now is more about politics than transparency.”
He further noted, “If the current administration truly prioritized transparency, it would have released Volume 2 of Special Counsel Jack Smith’s report concerning Donald Trump’s own classified document issues.”
The disputed document includes roughly 70 hours of recordings and transcripts. Biden was interviewed by Mark Zwonitzer, who was working on a book about the late Beau Biden. The recordings were collected during an investigation led by special prosecutor Robert Hur, related to alleged illegal retention and distribution of classified materials.
The former president’s memory lapses during the interview with Xu were later used by Republicans to label him as mentally unfit for office.
Biden refuted the report in February 2024, although he inadvertently made a notable error during a nationally aired speech.
President Donald Trump condemned Biden’s lawsuit via his account on “Truth Social,” exclaiming, “Crooked politicians!!!” He made this remark in response to a reporter’s inquiry about the lawsuit.
“This man is completely incompetent. The Democrats— I call them that because their policies are so detrimental— they’ve nearly ruined our country. We can’t allow that again, and I trust you can help with that,” Trump stated to reporters, concluding with, “It’ll be fascinating for people to read.”
