A federal judge, appointed by President Obama, has issued a temporary order preventing the National Park Service from taking down an anti-Trump flag that reads “86 47” near the National Mall. This decision grants a win to progressive activist groups, despite pushback from President Trump’s Interior Department.

A spokesperson for the Department of the Interior criticized the ruling, suggesting that it was surprising to see a judge from a Democratic background suggest that threats against the president should not be taken seriously. They emphasized that while the department follows court orders, they believe such behavior should be condemned.

The progressive group Accountability Now USA placed the flag in question, arguing that the National Park Service was infringing on their First Amendment rights by threatening to cancel their permits. U.S. District Judge Randolph Moss in Washington, D.C., issued the restraining order on Monday, allowing the flag to remain displayed for now.

This situation arises amidst heightened scrutiny from the administration regarding messages associated with “86 47.” Recently, former FBI Director James Comey was indicted due to similar messages.

Judge Moss, who has a background in the Justice Department under President Bill Clinton and was appointed by Obama, noted that the meaning behind “86” isn’t straightforward. He pointed out that the flag lacks violent imagery and doesn’t convey a nationalistic tone. According to him, the activist group raised the flag to encourage Congress to impeach Trump.

Moss commented on the importance of distinguishing between potential threats against the president’s safety and public expression. He suggested that the real danger to Trump’s life would outweigh the need to suppress free speech.
