A Subway customer angry that his sandwich wasn't cut in half has been charged with battery after allegedly throwing an offensive sub at an employee at the fast food chain, police said.
Alberto de Barros, 54, was arrested by police shortly after 5pm on Tuesday for a “disturbance” at a restaurant in Stuart, Florida.
According to a probable cause affidavit, Subway employee Cassandra Pierre-Louis told a Martin County sheriff's deputy that De Barros “became angry when he learned the sandwiches were not separated.” It is said that Obtained from The Smoking Gun.
After a brief altercation, de Barros “began creating a disruptive scene,” according to the affidavit.
Mr. Pierre-Louis then told Mr. de Barros that he no longer wanted to serve him, and he immediately called him.
During the call, “a sandwich was thrown at Mr. Pierre-Louis,” the report alleges.
The sandwich shocked Pierre-Louis's “middle and lower body.”
Deputies did not say what kind of sandwich DeBarros ordered.
When de Barros ran out of the restaurant, Pierre-Louis chased him outside and captured video evidence of his demeanor and car license plate.
When questioned by deputies, DeBarros admitted he was “upset that the sandwich wasn't cut,” but added: “I believe it was me, not Mr. Pierre-Louis, who threw the sandwich on the counter.” he said, the newspaper reported.
Store surveillance footage also showed him taking a sandwich from the counter and hitting Pierre-Louis with it.
Another employee was also present at the time of the assault.
De Barros was arrested on suspicion of misdemeanor assault and booked into the Martin County Jail.
Mr. DeBarros was released on $1,000 bail Wednesday.
He is scheduled to be arraigned on February 1st.
