U.S. District Judge Roger T. Benitez ruled Tuesday to block enforcement of California’s background check requirements for ammunition purchases.
California law requires anyone looking to purchase ammunition to undergo a background check similar to those used to purchase firearms.
The law implementing ammunition background checks was enacted under Senate Bill 1235, which usurped the permit-to-purchase scenario passed by California voters in 2016. The court challenge was directed at SB 1235 and its chief enforcer, California Attorney General Rob Bonta.
Mr. Benitez reviewed background check requirements in light of the Supreme Court’s ruling. blue en (2023) held that the decision was unconstitutional.

The plaintiffs also targeted a California law that prohibits ammunition purchased in other states and brought back to California. Mr. Benitez also ruled in favor of the plaintiffs regarding the import ban.
Mr. Benitez subsequently barred AG Bonta and his agents from enforcing ammunition background checks and import bans.
The case is Rose v. Bonta 18-cv-802 in the United States District Court for the Southern District of California.
