DeSantis defeats Disney in court over free speech lawsuit about parental rights bill

Court hands victory to Republican Florida Governor Ron DeSantis after throwing away Media conglomerate Disney has filed suit over the company’s objections to his custody laws.

Disney filed suit against Florida officials in March 2022 after losing its special district privileges for criticizing DeSantis over the passage of the Parental Rights in Education Act. This general law restricted controversial books that referenced gender selection and sexuality that could be offered to children in public schools.

Disney’s CEO at the time called the bill a “challenge to fundamental human rights,” and Congress responded by revoking the company’s special status for areas surrounding its theme parks. The lawsuit claimed the government’s action was retaliatory and violated free speech rights. right.

In a 17-page ruling, U.S. District Judge Allen Windsor said Disney had no standing to sue Florida officials.

“Disney does not allege that the new board has taken (or will take) any specific action as a result of the Governor’s alleged control,” Windsor wrote.

“In fact, Disney does not allege that any tangible harm was caused by the board’s actions,” he explained. “As discussed above, the alleged harm is that it is operating under an uncontrolled board. This harm would exist regardless of whether the governor controlled the board. This means that an injunction prohibiting the Governor from influencing the Board of Directors does not provide relief for the damages claimed by Disney.

Mr. DeSantis was lambasted by the left and many in the media who called the Parental Rights Act a “don’t call me gay” bill to exaggerate its effectiveness. The governor partially used the bill as a springboard to the presidential race, but dropped the effort after it lacked enough support.

Judge Windsor was appointed by former President Donald Trump.
