School acknowledges breaching student's constitutional rights regarding tribute to Charlie Kirk on rock and agrees to significant payment

High School Student Wins Settlement Over Free Speech Violation

A high school student has secured a $95,000 settlement after being accused of vandalism for painting a tribute to Charlie Kirk on a rock at her school. Gabby Stout, a student at Ardrey Kell High School, claimed that she and her classmates had obtained permission from school officials to create this tribute, which was meant to advocate for various causes.

The tribute included a large red heart along with phrases like “Freedom 1776” and “Live Like Kirk — John 11:25.” However, after she completed the painting, the school’s stance changed abruptly. Officials decided to cover up her artwork and went on to accuse her of vandalism, even indicating that an investigation was underway with law enforcement involved.

Stout expressed her disbelief at the school’s reaction, stating, “I was so scared… I had no idea what I was doing wrong or that I could get in trouble just for sharing and expressing my opinions and beliefs.”

In court, Stout’s family represented her with support from the Alliance Defending Freedom organization. Senior Legal Counsel Travis Barham highlighted that the school faced significant financial repercussions because it infringed upon Stout’s constitutional rights.

He emphasized how the school had publicly labeled Stout as a vandal, which was a serious accusation. They had disseminated this information to the entire school community. Following the settlement, the school was compelled to acknowledge that these accusations were unfounded.

Barham remarked, “This is exactly the kind of disgraceful statement we wanted to get from the school all along.” Interestingly, he noted that other political expressions, such as those related to the Black Lives Matter movement, were allowed on the rock without any issues.

This legal outcome also prompted the school to establish a formal policy regarding student free speech, in hopes of maintaining consistent guidelines for student expression.

Barham concluded that the settlement reflects a clear acknowledgment of students’ rights to free speech and highlighted the accountability of school officials when those rights are violated.
