West Virginia Attorney General Patrick Morrisey (R) on Tuesday called on Vice President Harris to invoke the 25th Amendment against President Biden, saying the president is physically unable to carry out his duties.
Morrissey said Biden’s mental health is a serious concern after a 388-page special counsel report released last week described him as a “well-intentioned elderly man with a poor memory.” he claimed. Biden aggressively pushed back against such characterizations.
“President Biden’s cognitive decline is of great concern to Americans, especially at a time when our nation is facing a series of crises at home and abroad,” Morrissey wrote. “We need a mentally sound president.”
The Republican attorney general said the report “paints a clear picture of a president who is unfit for the office of president.”
The report was the result of a year-long investigation into classified documents from Biden’s time as vice president, which were discovered in Biden’s former office and private residence in Delaware.
The 25th Amendment was passed by Congress in 1965 to clarify presidential succession following the assassination of former President Kennedy. It also included a provision that would allow the vice president and the Cabinet to remove the president from office if the president is deemed physically incompetent.
This power has never been exercised, but it surfaced after the January 6, 2021, attack on the Capitol by anti-Trump critics, some of whom dismissed the solution as not quick enough. Also included was Congressman Kevin McCarthy (R-Calif.).
A number of other Republicans have also brought up the use of the 25th Amendment against Biden in recent weeks, including Rep. Claudia Tenney (RN.Y.). Trump himself proposed the idea last September.
The call underscores the attention that both lawmakers and the public are paying to Biden’s age. Biden has come under increasing criticism in recent weeks after a series of misrememberings.
Although Biden and his team have dismissed such concerns, most polls show a majority of Americans think the president is too old to run for re-election.
