Justin Theroux’s neighbor declares bankruptcy after eviction order

Justin Theroux’s “nuisance” neighbor, who has had a long-running feud with the singer, has filed for bankruptcy after a judge ordered him evicted. The company has demolished a Manhattan building and paid more than $600,000 in legal fees, The Post has learned.

The bankruptcy case also halted a trial that was scheduled to begin in April over Mr. Theroux’s 2017 lawsuit alleging that his downstairs neighbor Resnikov harassed him.

In January, the “Mulholland Drive” actor and the co-op’s board of directors granted a request by a judge to evict the former real estate lawyer and his wife, Barbara Resnikov, from the apartment complex for harassing residents and causing trouble. , won another lawsuit. The Jan. 16 ruling also ordered the Resnikovs to pay the co-op’s legal costs.

Just three days ago, the Reznikovs put their 71 Washington Place duplex on the market for $4 million after living in the three-bedroom, 2,420-square-foot unit for 20 years.

The co-op board is seeking to recover more than $640,000 in legal fees in the eviction case and an additional $127,000 in the board dissolution lawsuit the couple lost.

According to bankruptcy documents, Mr. Resnikov paid his attorney more than $240,000 in legal fees.

The troubled neighbors are contesting the amount of legal fees owed to the co-op board in both cases, and are suing to lose in both cases.

Meanwhile, Resnikov wrote in an affidavit in the bankruptcy case that the couple plans to find another place to live and intends to “vacate” the condo in an “orderly manner” by Sept. 30.

He also said he intends to complete the sale of the units while he fights the appeal, according to court documents.

“Mr. Resnikov’s strategic bankruptcy filing on the eve of his trial is just his latest attempt to avoid his day in court,” Theroux’s attorney Eric Sherman told the Post. Told.

“We remain determined to hold Mr. Resnikov accountable, and bankruptcy protection does not protect him from liability for what courts have already determined to be unlawful and intentional conduct.”

Theroux claimed Resnikow began harassing him when he renovated the luxury bed he once shared with ex-wife Jennifer Aniston.

Theroux sued Resnikov in 2017, accusing him of trespassing on his part of the shared roof terrace, peeping into windows and killing ivy.
Mr. Resnikov put his condo up for sale in January for $4 million. Three days later, a judge ordered him removed from his unit.

The neighbors quarreled over the division of their shared roof terrace, and Mr. Theroux accused Mr. Resnikov of killing ivy, surveilling, and trespassing on his side of the terrace.

Manhattan judges have already sided with Theroux in this case twice, the first ruling that Resnikov: liable for trespassing He was also found responsible for causing personal nuisance to the actor.

The April trial was scheduled to determine the amount, if any, of Mr. Theroux’s damages.

Mr. Resnikov’s lawyer, Peter Levine, declined to comment.
