Man found guilty of rape of girl, 15, in sea off Bournemouth beach | Dorset

A 20-year-old man has been found guilty of “brazen” rape after plucking a 15-year-old girl from the deep waters off Bournemouth Beach.

A jury found Gabriel Malinoaica, of Dallastan, Walsall, guilty of three counts of sexual assault and rape. She was acquitted of a further charge of sexual assault for biting her neck.

Judge Susan Evans KC said it was a “brazen act in broad daylight” on the beach.

“Unfortunately, I cannot grant bail, but I will order a pre-sentence report. In either case, the only outcome is detention.”

Ellie Fargin, prosecuting, told the trial at Bournemouth Crown Court that the victim, who was unable to swim, was in the sea with friends off the coast of a resort in Dorset on Sunday, July 18, 2021, when another group of people in the water He said he started playing ball games.

The girl continued playing with the ball after her two friends returned to the beach. Fagin said she went to retrieve the ball after the Malinois squid picked it up after it was kicked away.

Fagin said he then groped the girl, kissed her and raped her for about a minute before someone approached them. She said the Malinois squid had her hand over her mouth so she couldn’t scream.

He claimed she initiated sex and asked if she wanted to have sex.

“He took her out of the deep and left her defenseless, unable to even swim. He may not have known it, but he may have known she couldn’t touch the bottom. not.

“So why did he do that? So he could do what he wanted. She didn’t agree, and we don’t know if he knew that.” – he just didn’t care,” Fagin said.
Malinoaica was arrested 11 months later after her DNA was found on her accuser’s bikini, jurors said.

Malinoaica was taken into custody and sentenced on April 19th.
