Some illegal immigrants to New York may be denied emergency housing resources due to changes in state practices.
New York City Mayor Eric Adams announced Friday that he is significantly rescinding the city’s infamous “right to shelter” policy, which requires beds to be provided to individuals who need them.
Under the new terms, individuals will be entitled to 30 days of housing services when they enroll in the city’s assistance program.

After a 30-day grace period, the city can deny an individual’s readmission to the system, but only if the city has “some extenuating circumstances that require an additional short-term shelter stay.” unless he or she proves that he or she has a disability or receives the necessary reasonable accommodation,” Adams’ office said.
Families will continue to be comprehensively covered under the Mitigation Act and cannot be turned away if they are looking for housing.
“This new agreement recognizes the reality of where we find ourselves today, affirms our shared mission to help those in need, and builds on our commitment to overcome this ongoing crisis,” Adams said in a video statement. It gives us more flexibility.”

The compromise would place limits on an individual’s “right to housing,” while requiring housing authorities to provide as much procedural and material assistance as possible during the month the housing is provided.
New York City’s system must help each immigrant find a permanent place to rehouse while in custody. Expected efforts include arranging a meeting with an immigration attorney and applying for a resettlement program.
Adams called for the “right to shelter” requirement to be completely abolished in October 2023, citing the emergency situation caused by the influx of migrants.

The Legal Aid Society, a nonprofit civil law organization, objected to this effort and helped negotiate the current agreement.

Hines, general counsel for the New York City Corporation, said, “The reasonable plan outlined in this settlement will significantly enhance and require the City’s ability to manage the extraordinary influx of people we care for.” It will help stabilize the shelter system for people.” – Radix, according to Politico.
