According to Roberts, the appeals court said Navarro “was required to appear before Congress and answer questions seeking information outside the scope of the claimed privilege.”
“We see no basis for agreeing with the finding that Mr. Navarro has waived these claims,” the chief justice added.
Navarro said his appeal “shows that his appeal presents significant questions of law and fact that are likely to result in a reversal, a new trial, or a sentence that does not include prison time or a lesser sentence.” ‘No,’ he has already served time in prison, plus the expected length of the appeals process,” a federal appeals court said last week, denying his request for a stay.
