John Eastman responds to disbarment call, says he’s been subpoenaed by Capitol Police

Trump’s former lawyer John Eastman last week downplayed a California judge’s request for his disbarment, arguing that he still had a good chance of winning on appeal, and on January 6, 2021. He revealed that he has been subpoenaed in another case related to the Capitol riot.

The judge accused Eastman, who was a central figure in the effort to overturn the 2020 election, of making “false and misleading statements” about alleged election fraud and his role in “inciting” the January 6 riot. For these reasons, it recommended that Mr. Eastman be disbarred.

Eastman said in an interview. Conservative network “Frank Speech” “There’s still a lot of water under the bridge,” he said Thursday before the state Supreme Court heard his case.

“If the law had been faithfully followed, this case should never have been filed in the first place,” he said.

“We had disagreements over the facts of the 2020 election. We had disagreements over constitutional interpretation that remain unresolved,” Eastman continued. “That has never been the basis for any disciplinary action.”

State’s Attorney Judge Yvette Rowland found Eastman guilty on 10 of 11 charges.

“Given the circumstances surrounding Eastman’s misconduct and the balance of aggravation and mitigation, the court recommends Eastman’s disbarment,” she wrote. 128 page decision.

While his case is under appeal, Eastman has been suspended from practicing law in California.

In an interview Thursday, he claimed the disenfranchisement was political in nature and “aimed at destroying our adversarial justice system.”

He also said the subpoena was issued as part of a civil lawsuit filed against former President Trump by a group of Capitol Police officers. Officers say Trump is responsible for the events of January 6 and want to fine him for the violence he suffered during the riot.

“Last week, I received a subpoena from a Capitol Police officer to investigate all of my communications with the president and others,” he said. “They completely blew away attorney-client privilege.”

Mr. Eastman also remains a key figure in special counsel Jack Smith’s criminal case against Mr. Trump related to the Capitol attack. Eastman echoed Trump’s own criticism and accused prosecutors of being politically motivated.

“We don’t seem to have the idea of actually pursuing the truth in these criminal cases. It’s all a trap for political opponents,” he said. “Whatever they think will advance their agenda to get Trump.”

“That’s part of the game,” he continued. “By tying us up and spending resources on defense against these things, we cannot devote those resources and manpower to promoting the election of people who are smart and want to get the country back on track. ”
