Employees at a Taylorsville burger joint called police on Tuesday to report the family “appeared to be homeless and in need of assistance,” according to an arrest affidavit.

When police arrived, they said they found 36-year-old Rodolfo Martinez Avila “sitting face down at a table with drool dripping from his mouth.”
Martinez Avila is the boyfriend of 23-year-old Azucena Rodriguez and the mother of their two children, a 4-year-old and a 6-month-old.
The man “appeared to be confused by simple commands or statements, continued to move rapidly, fidget, and generally appeared unable to express himself,” according to the affidavit.
Police said the boy had dried blood running down his nostrils and when paramedics asked if he had any injuries, he showed bruises on his chest. When asked who was injured, the boy said it was Martinez-Avila’s fault.
Police said, “The 4-year-old and 6-month-old children were placed in the back seat of the ambulance.” “Officers noted numerous injuries on the four-year-old, including bruises on both arms, torso and back, scratches on the abdomen, and the aforementioned nosebleed. The six-month-old child appeared to be malnourished; There is a possibility of injury.”
More extensive injuries were recorded after the children were treated at Primary Children’s Hospital, the affidavit said.
The mother told police she witnessed Martinez-Avila abusing the children but did not stop because she was threatened. She also told police she was homeless, but police said she had “other places to live and stay, but she refuses to go there.” he pointed out.
Police said Martinez-Avila admitted to grabbing the boy’s arm that day and also said he had taken methamphetamine the day before.
The mother admitted to taking meth “regularly,” according to the affidavit. Police also said Martinez Avila was deported from the United States several years ago and returned illegally.
The mother was arrested on suspicion of child abuse, and the boyfriend was arrested on suspicion of aggravated child abuse, intoxication, and possession of drug paraphernalia.
The children were taken into the custody of Child Protective Services.
Taylorsville is a suburb of St. Lake City with a population of approximately 60,000.
