Former President Donald Trump is in the midst of multiple legal battles, but everything could change if the Supreme Court rules that he has full presidential immunity.
“The court is far more concerned about the presidency than it is about President Trump,” said National Review contributor Andrew McCarthy. Glenn Beck.
“This is an important point because much of the reporting has been about the hysteria about whether the Supreme Court, packed with Trump supporters, is going to weigh against Trump and preclude prosecution of Jack Smith. That’s why,” McCarthy said. “I don’t think that’s going to happen at all.”
Rather, McCarthy said the court would take the case to a trial court in Washington “with instructions to sort out what in the indictment against Trump constitutes so-called ‘official conduct’ that could conceivably evade prosecution.” I believe it will be remanded. What private act or private wrongdoing does he have impunity for? ”
However, McCarthy said Trump’s lawyers acknowledged that much of the conduct charged in the indictment is considered private and does not qualify for immunity.
“What are some acts that could be considered private?” Glenn then asked, “What are some acts that you wouldn’t prosecute, even though you’re the president?”
One of the “robust examples” used by McCarthy is that “Trump’s lawyers believe that if Trump concocted a private scheme with his private attorney to obtain the electoral roll nominated to him, and that it was authentic.” “He has admitted to providing Congress with documents that suggest they are the actual electoral rolls of the United States.” If they were state-appointed electors, it would be a private act because it was purely a pursuit of public office. ”
“On the one hand,” McCarthy explains, “the indictment alleges that Trump used the Justice Department to try to communicate to states that he had serious concerns about fraud, and received backlash. The Justice Department sent a letter it never sent to the state of Georgia saying it needed further scrutiny of what happened in the popular vote. ”
“Mr. Trump has been very vocal about it, and the courts will probably follow suit, and that’s presidential control over the Justice Department,” he says.
