CNN legal analyst Ellie Honig, a former federal prosecutor, believes Stormy Daniels’ testimony had a “pretty dire outcome” for Manhattan District Attorney Alvin Bragg.
On Tuesday, the former porn actress took the stand in Donald Trump’s hush money trial. testify He spoke for hours about his relationship with Trump. At one point, Trump’s lawyers said: requested a mistrial New York State Supreme Court Justice Juan Marchan rejected the move because Ms. Daniels provided sordid details about her relationship with Mr. Trump, even suggesting that the sexual encounter was non-consensual. . Trump’s lawyers argued that such testimony was “highly prejudicial.”
“The prosecution went too far in the details they elicited.”
Honig responded to CNN’s testimony, calling Daniels’ answers on cross-examination “disastrous” for prosecutors.
“Her response was dire. I mean, ‘Do you hate Donald Trump?'” Yes, of course she does. “If a witness hates the person whose freedom is at stake, that’s a big deal,” Honig explained.
“And she’s tweeting fantasies about him being in prison? That really undermines credibility,” he noted.
Ms. Honig not only believed that Ms. Daniels’ comments undermined her credibility as a witness, but she also described how Mr. Daniels demonstrated that she had no respect for the legal system. .
“The fact that she owes him $500,000,” Honig said. “She owes Donald Trump $500,000 by court order and said, ‘I will never pay him, I will defy the court order’? The defense said, ‘ She’s going to disobey the court’s order.’” She’s not going to respect the judge’s order, so why would she honor this oath she took? ”
“So I thought I did pretty poorly on cross-examination. When the direct examination ended, I thought, ‘Okay, they got what they needed.’ But the cross really penetrated I think it’s happening,” he explained.
Honig also believes prosecutors damaged the case by taking “cheap shots” during Daniels’ testimony.
That cheap shot, he explainedare the questions prosecutors asked Daniels to elicit “irrelevant details about sexual contact” between Daniels and Trump.
“The prosecution went too far in the details they elicited,” Honig said. “Yes, I think it was the right move by the Donald Trump campaign to seek a miscarriage of justice.”
Daniels is scheduled to take the stand again on Thursday.
