Rep. Stefanik files misconduct complaint against Judge Merchan, says his selection for Trump NY case was ‘not random at all’

U.S. Rep. Elise Stefanik (R-New York) on Tuesday filed a misconduct complaint against Acting Judge Juan Marchan, alleging his “repeated appointment” to cases involving former President Donald Trump and his associates.New York Post report.

Stefanik argued that her selection in the criminal case against Trump in New York and other cases involving Trump allies was “not random at all.”

“Those who carried out this task deliberately selected Acting Judge Marchan.”

“Manhattan Acting Judge Juan Marchan, a Biden donor whose daughter has raised millions for Biden’s unprecedented campaign, has filed a formal misconduct complaint with the New York State Unified Court System in connection with his ‘random’ appointment to criminal proceedings against President Donald J. Trump, his companies and allies,” Stefanik wrote to X on Tuesday.

In a letter to the inspector general of the New York State Unified Court System, Stefanik noted that in addition to overseeing the ongoing New York criminal case against the former president, Marchan “will also preside over the criminal trial of the Trump Organization and will preside over the criminal trial of Steve Bannon, a senior White House advisor to President Trump and a prominent supporter of President Trump.”

She noted that there are at least 24 other sitting justices on the Supreme Court.

“If judges in criminal courts are truly appointed randomly, the likelihood of any two particular criminal cases being assigned to the same judge is extremely low, and the likelihood of any three particular criminal cases being assigned to the same judge is extremely small,” she continued.

Judge Stefanik argued that Marchand’s selection was “not random at all.” The acting judge has donated to President Joe Biden’s 2020 campaign and other left-leaning groups, she added. Judge Stefanik commented that Marchand’s daughter works for a progressive political consulting firm.

According to Federal Election Commission records, Marchan donated $15 to the Biden for President campaign, $10 to the Progressive Voter Turnout Project and another $10 to Stop Republicans, The Washington Post reported.

“The simple answer as to why Acting Judge Marchan was assigned to these cases is that whoever appointed her deliberately chose her to preside over these cases in order to increase the likelihood that Donald Trump, the Trump Organization, and Stephen Bannon will ultimately be convicted,” Stefanik asserted.

The lawmakers called for an investigation into Marchan’s selection “to determine whether the required random selection process was in fact adhered to.”
