Nevada Judge Dismisses Fake Electors Case, Citing Wrong Jurisdiction

A Nevada judge has dismissed a supplementary electoral lawsuit against six Republicans who filed supplementary electoral certificates challenging the results of the 2020 presidential election, finding the case was brought in misplaced jurisdiction.

Clark County District Judge Mary Kay Holthus halted the trial, which had been scheduled for January, after determining state prosecutors committed crimes that “occurred in another jurisdiction,” the judge said in a statement. Nevada Independent.

This happened after the grand jury Indicted Six Republicans, namely Nevada Republican Party Chair Michael J. McDonald, Nevada Republican Party Vice Chair Jim Hindle, Jim DeGraffenried, Jesse Law, Sean Meehan and Eileen Rice, were added to the electoral rolls in December 2023. The six replacement electors were responsible for filing replacement electoral certificates in connection with what liberal Democrats call a “fake elector” conspiracy.

According to the outlet, Holthus’ ruling came after hearing arguments from prosecutors explaining why Clark County was the appropriate county to try the case, even though the alternate elector had signed the paperwork in Carson City and the paperwork had been mailed from Douglas County.

“In my opinion, this is a crime that literally happened in another jurisdiction,” Holthus explained, “something that happened up north, something that just didn’t happen here.”

In response to Holthus’ sentence, Nevada Attorney General Aaron Ford said the judge “erred in his decision” and that he would appeal the sentence to the U.S. Supreme Court.

The media outlet noted that because the statute of limitations has expired, there will be no option to file the lawsuit again.

The state cannot refile the lawsuit in the North because the three-year statute of limitations expired in December.

Alternate electors in states including Michigan, Arizona, Georgia and Wisconsin have been indicted or charged by grand juries for their roles in contesting the results of the 2020 presidential election.
