Two years after Dobbs decision, North Carolina abortion law among strictest

Two years after the U.S. Supreme Court overturned a ruling returning abortion law to the states, North Carolina is one of two states that restrict abortion at 12 weeks after fertilization.

It’s been a hot topic of discussion since the June 24, 2022 announcement, and one that political campaigns have grappled with, with Democrats using it to gain success in the polls and Republicans preaching conservative values.

Roe v. Wade governed the country for nearly half a century.

Since the ruling was overturned, it has become an even more visible feature of progressives.

Fourteen states restrict abortion later in life, and three states restrict abortion within six weeks of fertilization.

State Democrats continue to attack Republican Lt. Governor Mark Robinson, who has said he will “not compromise on abortion” and “will not allow abortion under any circumstances.”

Democrats say Robinson would change North Carolina’s laws if he defeats Attorney General Josh Stein.

Executive orders are the Governor’s tool of authority; he does not initiate legislation.

And state lawmakers, frustrated with Gov. Roy Cooper’s use of his powers, have taken steps to weaken them.

It came into effect on December 1st.

The law prohibits abortions after 12 weeks of pregnancy, with limited exceptions.

The state’s previous law banned abortions after 20 weeks of pregnancy.

Exceptions are made up to 20 weeks for rape and incest, and up to 24 weeks for “life-threatening” foetal abnormalities.

There are medical emergency exceptions.

The Supreme Court’s June 13 announcement on mifepristone was met with much praise from the state’s Democrats, but Republicans were largely silent.

Polls conducted in the state since May 1 have shown that the economy is the most common issue for voters, followed by abortion and immigration.

“Abortion will be a top issue that we advocate for, to make sure that North Carolinians know they have to protect not just abortion but contraception as well,” state Democratic Party Chairman Anderson Clayton said in April.

Other states have a limit of 15 weeks after conception, while others have a limit of 18 weeks.

Four limit themselves to 20 or 22 weeks after their last menstrual period.

Four other states restrict abortion to 24 weeks after the last menstrual period.

Eleven states restrict abortion at the point of fetal viability, and one state restricts abortion later in pregnancy.

In overturning the ruling, the Supreme Court defined fetal viability as about seven months, or 28 weeks, but said viability can occur earlier than 24 weeks.
