Former President Trump is celebrating the Supreme Court’s decision on Monday that ruled that former presidents have broad immunity from criminal prosecution.

The Supreme Court handed the former president a major victory by sending a federal lawsuit related to his efforts to overturn the results of the 2020 election back to a lower court to decide whether his actions met the requirements of immunity.
Trump and his legal team have argued that he should be immune from criminal prosecution for acts he committed while in office, and the Supreme Court, in an ideologically-aligned 6-3 decision, ruled that he has broad immunity for acts he performed while in office.
“At least with respect to the President’s exercise of his core constitutional powers, this immunity must be absolute. With respect to the rest of his official duties, the President is at least entitled to a presumptive immunity,” Chief Justice John Roberts wrote in the majority opinion.
The ruling then noted that “there is no immunity for unofficial conduct.”
The ruling sent the federal election interference case back to district court, pausing proceedings while the Supreme Court considers Trump’s immunity claim. Judge Tanya Chutkan, who is presiding over the case, will have to rule on that issue for a second time and also toss out the case on Trump’s other claims.
