New York v. Trump: Merchan delays sentencing hearing until September

Judge Juan Marchand has postponed former President Trump’s sentencing in New York State v. Trump until September, following a request from leading Republican candidates and a lack of opposition from Manhattan District Attorney Alvin Bragg.

Trump was convicted last month of all charges of first-degree falsifying business records in an unprecedented criminal trial after a six-week trial that stemmed from Bragg’s investigation.

President Trump moved Monday to overturn the conviction in the Manhattan case. U.S. Supreme Court The court ruled that the former president has substantial immunity for official acts committed while in office, and also requested a postponement of his sentencing, which had been scheduled for July 11, just days before the Republican National Convention, where he is scheduled to be formally nominated as the 2024 Republican presidential candidate.

Bragg said Tuesday morning that Trump’s request to have the sentence overturned was without merit, but he did not oppose a request to delay the sentence.

Marchan on Tuesday afternoon postponed Trump’s sentencing date to 10 a.m. on September 18th.

“Accordingly, the July 11, 2024 sentencing date is void. The Court’s ruling will be unscheduled for September 6, 2024, and the matter will be adjourned until September 18, 2024 at 10:00 a.m. for sentencing or other proceedings, if still necessary,” Marchan wrote in a letter to Trump’s lawyers and New York prosecutors.

Trump Moves to Overturn Manhattan Lawsuit Following Supreme Court Immunity Decision

Marchan’s decision came in the wake of the Supreme Court’s 6-3 ruling on presidential immunity, an issue that stems from charges brought against President Trump in a separate federal lawsuit brought by special counsel Jack Smith related to the Jan. 6 breach of the U.S. Capitol and alleged attempts to overturn the results of the 2020 election.

But Trump’s lawyers moved quickly to apply the new standard to the Manhattan case.
