Supreme Court Upholds State Ban on Biological Boys in Women’s Sports

The Supreme Court has endorsed laws in Idaho and West Virginia that restrict biological males from competing in women’s sports. Legal experts, including constitutional law attorney Jonathan Turley, noted that the ruling indicates that transgender status isn’t treated as a protected class akin to race or religion, leaving decisions up to individual states.

First Lady Melania Trump reacted on social media, highlighting a point from her memoir soon after the ruling was announced. She expressed support for both the LGBTQIA+ community and for protecting women athletes, saying, “We must also ensure that female athletes are protected and respected.” She directed readers to a specific page in her book that aligns with her views.

President Trump weighed in as well, stating that the decision affirmed the legality of maintaining women’s sports for biological females under Title IX and the Equal Protection Clause. He emphasized the need for both respect for all individuals and fairness in women’s sports, suggesting these ideals can coexist.

The Supreme Court’s decision came in the wake of combined cases such as West Virginia v. BPJ and Little v. Hecox, where the justices ruled 6-3, validating state laws that mandate student-athletes to compete based on their sex at birth rather than their gender identity. This influential ruling marks a significant win for “Save Women’s Sports” advocates and supports similar laws in 27 states, reducing ongoing legal uncertainties.

Justice Sonia Sotomayor expressed partial agreement but also dissent, joined by Justices Elena Kagan and Ketanji Brown Jackson. State officials praised the ruling, with West Virginia’s Attorney General calling it a pivotal victory for female athletes. Similarly, Idaho’s Attorney General celebrated the affirmation of their authority to ensure fair competition that women have long advocated for.

This legal challenge focused on the Women’s Sports Preservation Act in West Virginia and Idaho’s Women’s Sports Fairness Act, both of which faced opposition from transgender athletes.
