A Delaware judge on Monday dismissed a lawsuit against Fox News brought by Nina Jankowitz, former chair of the now-disbanded Department of Homeland Security (DHS) Disinformation Commission.

Fox News on Monday praised the judge’s decision, saying it “is a politically motivated lawsuit aimed at silencing free speech and we are pleased with the Court’s decision to uphold the First Amendment.”

Nina Jankowitz’s lawsuit alleges that Fox repeatedly defamed her and that she was subjected to a series of online attacks and threats of violence after the creation of the Disinformation Control Board, on which she served.
In May 2022, just weeks after it was launched, the Department of Homeland Security suspended the committee’s activities and accepted Jankowitz’s resignation. The committee was formally dissolved and its authority revoked in August of the same year.
The judge rejected Jankowitz’s argument, saying 36 of the 37 statements made on the Fox News show were about the Disinformation Committee, not Jankowitz. The remaining statements were about the committee, not Jankowitz, even though Jankowitz’s image was in the commentary, but the judge ruled they were factual statements consistent with language in the committee’s charter describing its purpose and therefore not disinformation.

Jankowitz has not released a statement on the outcome of the lawsuit. Her social media posts over the weekend focused primarily on Vice President Kamala Harris as a possible successor to Joe Biden following his withdrawal from the race.
