Former President Donald Trump (Republican) is reportedly taking legal action against President Joe Biden’s (Democrat) Department of Justice over the unusual Aug. 8, 2022 search of his Mar-a-Lago estate in Palm Beach, Florida.
The former president plans to sue the Department of Justice for $100 million in damages. Fox News Reported He said Monday that the memo alleges “unlawful actions by the United States against President Trump.”
The search came amid a federal investigation into Trump after he was accused of improperly storing classified records.
“Following the search, Special Counsel Jack Smith was appointed to the investigation. Smith ultimately filed 37 felony charges against Trump, including willful retention of national defense information, conspiracy to obstruct justice and making false statements. Trump has pleaded not guilty to all charges,” the Fox report said.
In July, U.S. District Judge Eileen Cannon dismissed the lawsuit against Trump, citing the Appointments Clause of the Constitution and ruling that Smith was illegally appointed and funded.
Regarding the search of his home, Trump said, “This is a dark time for our country as my beautiful home, Mar-a-Lago in Palm Beach, Florida, is currently surrounded, searched and occupied by many FBI agents. Nothing like this has ever happened to a President of the United States.”
He later said that the FBI conducted a “thorough and nasty search” of his son, Barron Trump’s room, and Melania Trump reportedly bought new clothes after agents searched her room and her clothes were “contaminated,” according to Breitbart News.
Regarding Trump’s planned lawsuit against the Department of Justice, his lawyer, Daniel Epstein, said, “What President Trump is doing here is not just standing up for himself. He’s standing up for all Americans who believe in the rule of law and who believe that they should hold their government accountable when they have been wronged.”
A September 2022 I&I/TIPP poll found that the attack on Trump’s home had no negative impact among Republicans on his then-“potential” 2024 presidential bid, according to Breitbart News.
Trump is currently battling Democratic Vice President Kamala Harris for the White House in the fast-approaching November election.
