Republican lawmakers are in a celebratory mood after the Supreme Court, in a 5-4 decision on Friday, rejected an emergency request by the Biden administration to partially reinstate new Title IX rules that, if implemented, would protect against discrimination based on sexual orientation and gender identity.
“Unlike Democrats, Republicans know what it means to be a woman, and they know that Title IX was enacted to protect women’s rights,” said House Speaker Mike Johnson (R-Louisiana). wrote on social media platform X. “We commend the Supreme Court for upholding the lower court’s injunction.”
“For now, the Supreme Court has blocked attempts by the Biden-Harris administration to undermine women’s rights and allow men to participate in women’s sports,” he added.
Title IX bans sex discrimination in schools, and Biden finalized the new rules in April. The new rules reinstated Obama-era bans on sexual assault that were rolled back under the Trump administration.
The new rules also include sexual orientation and gender identity as discrimination protections for the first time, preventing schools from denying care or services to transgender people and other members of the LGBTQ community.
“I am pleased that the Supreme Court joined Louisiana and other states in upholding an injunction against the egregious Biden-Harris Title IX rules that allow facilities to allow biological males into women-only spaces like restrooms and locker rooms,” said Sen. Bill Cassidy (R-Louisiana). I wrote it to X.
The rule was set to go into effect on August 1, but Republican state attorneys general in 10 states have sought to block it from going into effect.
“Today, the Supreme Court delivered a victory for women and decency. The Biden-Harris Administration’s reckless attempt to redefine Title IX was rejected,” said Rep. Andy Barr (R-Ky.). I wrote it in an online post. “We must protect the integrity of women’s sports and the privacy of our daughters.”
Lower courts have upheld those cases, blocking the Education Department from enforcing the rule in Tennessee, Louisiana and eight other Republican-majority states. The Supreme Court on Friday denied an emergency request to temporarily ignore those rulings because those cases are still pending.
“The Supreme Court has blocked the Biden-Harris effort to redefine Title IX,” said Rep. Kevin Hahn (R-Okla.), chairman of the Republican Study Council. Written Regarding X: “Women’s sport and my daughters’ privacy are non-negotiable, and I commend the court for taking a firm stance on both.”
Many on the right have turned the debate over transgender women, or women born male, participating in women’s sports or using women’s restrooms into a culture war issue, with the Human Rights Campaign countering that Republicans lack evidence to back up their claims against the transgender community. criticized They claimed the attacks were “based on discrimination, not fact.”
“This is a big win,” said Sen. Joni Ernst (R-Iowa). Written online“The Supreme Court rules against the dangerous Biden-Harris rewrite of Title IX: Men should not be allowed in women’s sports or bathrooms.”
Rep. Marjorie Taylor Greene (Republican, Georgia) He praised the decision. Calling it a “huge win” for women, X added in her post, “I can’t believe this is even an issue!”
More than 20 states have moved to restrict access to gender-affirming care and other rights, and there have been increasing reports of poor mental health and suicidal thoughts among members of the LGBTQ community, particularly young people.
Friday’s ruling came on an emergency motion, meaning the lawsuit against the new Title IX rules is still pending and could eventually end up on the Supreme Court docket.
