Trump plans to be in NYC this week for appeal arguments in E. Jean Carroll sex assault suit

Donald Trump is scheduled to travel to New York City this week to attend a court hearing where his lawyers plan to argue for overturning a $5 million jury verdict that found him guilty of sexually abusing author E. Jean Carroll, sources told The Post on Tuesday.

The 2024 Republican presidential candidate is scheduled to appear at arguments scheduled for 10 a.m. Friday at the Manhattan Federal Court of Appeals in Lower Manhattan, according to a source familiar with the matter.

Trump was convicted in May 2023 of sexually assaulting the “Ask E. Jean” advice columnist in a Bergdorf Goodman fitting room in 1996 and then defaming her in an Oct. 12, 2022 Truth Social post by calling her allegations a “hoax.”

In their appeal, the former president's lawyers argued that Trump did not receive a fair trial in New York, according to court documents.

They also claim that the judge in the case repeatedly made “flawed and biased” decisions, including allowing testimony from two other accusers of sexual assault against Trump and playing the infamous “Access Hollywood” tapes to the jury.

As well as hearing from 80-year-old Carroll about the alleged assault, jurors also heard from Jessica Leeds, who said Trump groped her on a plane in the late 1970s, and Natasha Stoynoff, who tearfully described how the real estate mogul allegedly forcibly kissed her at Mar-a-Lago in 2005.

Jurors also heard the infamous recording in which the 45th president said that because he was a star, women would let him grab his “private parts.”

“This case is a gross misconduct based on false and unsupported allegations made with the support of political activists who have long opposed President Trump and his politics. [Carroll]The November appeal brief stated:

Trump has repeatedly denied knowing Carroll, that she is not his type, and that the alleged incident never happened.

A second trial in January awarded Trump $83 million in damages after a jury heard a separate lawsuit alleging that Trump defamed Carroll and damaged her reputation as a journalist when she published her allegations in June 2019.

Hours after her allegations were published, Trump called Carroll a “crazy person” and said she should “pay a high price” for her accusations, and she claims that Trump has continued to disparage her ever since.

Trump is also appealing the second ruling, but oral arguments have not yet been scheduled.

These are just some of several legal headaches for Trump, who was convicted in May of falsifying documents to conceal a series of “hush money” payments before the 2016 election. He is scheduled to be sentenced in Manhattan Supreme Court on Sept. 18.

Trump has two additional criminal cases pending in state court in Georgia and federal court in Washington, D.C., alleging he interfered in the 2020 election.

A third criminal case in Florida federal court that accused Trump of hiding classified documents in his Mar-a-Lago home and then lying about it was recently dismissed by a judge. The federal government is currently appealing the decision.

Trump was also found liable for widespread fraud in his business matters and was forced to pay $455 million in damages.

He claims his legal woes are all part of an effort by his former opponent, President Biden, the Democratic Party, to block him from winning the 2024 election.

Carroll's lawyer did not immediately respond to a request for comment Tuesday.
