The left has been working overtime as it continues to relentlessly try to put as many obstacles in former President Donald Trump's path as possible, and as Election Day approaches, they're working overtime.
Special Counsel Jack Smith is no exception, relaunching the classified documents case against Trump in an effort to put the Republican presidential candidate behind bars.
“The new indictments confront the old ones,” said former Assistant Attorney General Jeff Clark. Glenn Beck“It's exactly the same as the old indictment. He's just rewritten it and tried to fit everything into a third box.”
“They argue that President Trump's initial charges were in fact a series of private acts rather than a series of public acts, and therefore Jack Smith is not immune from liability,” Clark explained.
“Are they doing this as another attempt to smear Trump in the closing stages of the election? Or are they thinking this will keep Trump out of office in case he wins?” Glenn asked.
“That's why they're doing it,” Clark said. “They want to stop him by any means necessary. This is election interference. There's no way they'd have a new grand jury bringing a new indictment like this this close to a presidential election.”
Glenn doesn't like this situation.
“I expect he'll be in jail in September,” he told Clark.
Clark, who is scheduled to appear in Judge Marchan's courtroom in Manhattan on Sept. 18 to be sentenced, has similar concerns.
“Judge Marchan will deny the immunity request and then impose a sentence, and I would not be surprised if he sentences President Trump to prison,” Clark said.
But if Trump is convicted, he could still win the election.
“Any kind of incarceration would have to be terminated or suspended during the post-inauguration period,” Clarke explains. “This would be what lawyers call constitutional preemption, because the president is the duly elected and sworn-in president of the United States.”
“A state conviction cannot prevent him from performing those duties,” he added.
